1. Preamble
1.1. Welcome to it-som.net and the mobile application of the same name (together with domains, content, branding, and services, hereinafter referred to as the “Website”, “App”, or collectively the “Services”). The Services are owned and operated by Kivaro Tech (SOM brand / PE Makovska G. V., EDRPOU: 2363501306), which provides its services in accordance with the legislation of Ukraine.
1.2. This document (Terms of Use, Agreement, Offer) along with the Privacy Policy is a public offer agreement (End User License Agreement – EULA) and establishes the terms of the contractual relationship between SOM (“We”, “us”, “our”) and any person using our Services as a user (“Giveaway Organizer”, “Participant”, “User”, “you”, “your”). By using the Website or the App, you confirm that you have read and accepted these Terms. If you do not agree with the Agreement, you must stop using the Services.
1.3. SOM reserves the right to change these Terms of Use at any time. The User is obliged to independently track any changes.
1.4. In the event of discrepancies between the language versions of the Agreement, the Ukrainian version shall prevail.
2. Regulatory Status
2.1. SOM’s activities do not constitute the organization of gambling or lotteries and do not require special licenses in any country in the world. We exclusively provide software (a tool) for data processing.
2.2. SOM operates in accordance with the legislation of Ukraine, complying with the laws of the countries where the services are provided, as well as the global rules of the App Store platform.
3. Eligibility and
Lawful Use
3.1. The Services are not intended for persons under 18 years of age. If you are under 18, you are prohibited from using the Services.
3.2. You are responsible for using the Services in compliance with all applicable laws and regulations.
4. Access to and Use of the Services
4.1. The Services allow organizers of giveaways on social networks (Instagram, TikTok, Facebook, YouTube, etc.) to generate a random number, parse comments, or verify giveaway conditions using the Randomizer to select a winner (hereinafter – Services).
4.2. We grant you a limited, non-exclusive license to use the Website and the App, provided that you will not: (a) copy or modify the Services; (b) use automated systems to interfere with the API; (c) use the Services for fraudulent purposes; (d) bypass security features.
5. Registration and Account
5.1. Some features of the Website are available without registration; however, full use of the Mobile App may require creating an account (via Email, Sign in with Apple, Google Sign-In, or Guest Login).
5.2. You warrant that you provide accurate data and do not use the Services for illegal purposes.
5.3. You have the right to delete your account at any time in the App settings.
6. Payment for Services, Subscriptions, and Refund Policy
6.1. Some of the Services are paid (Premium Packages, Subscriptions).
6.2. Web Payments (Website): Payment on the Website is made through third-party payment systems. SOM does not store your payment data and is not responsible for failures on the side of payment systems.
6.3. In-App Purchases (StoreKit): All subscriptions and payments made within the iOS App are processed exclusively by Apple (via your Apple ID).
6.3.1. Subscription Auto-Renewal: Subscriptions via the App Store automatically renew unless auto-renew is turned off at least 24 hours before the end of the current period. Payment will be charged to your Apple ID account.
6.3.2. Subscription Management: The User can manage subscriptions and turn off auto-renewal in their Apple ID account settings after purchase.
6.4. Refund Policy: All purchases made on the Website are final, except in cases of technical failures on our part. Important: Refunds for subscriptions purchased via the iOS App (Apple StoreKit) are handled exclusively by Apple in accordance with its refund policy. SOM does not have the technical ability to issue refunds for App Store transactions.
7. Terms of Service
7.1. SOM is not an organizer of giveaways or contests, does not conduct them, and cannot adjust the conditions of Users’ giveaways.
7.2. Any responsibility for the description, execution of giveaways, fulfillment of social network rules, and awarding of prizes lies solely with the Giveaway Organizer.
8. Determining Winners (and Apple Disclaimer)
8.1. A giveaway participant is recognized as a social network user who has fulfilled the Organizer’s conditions.
8.2. The Giveaway Organizer gains access to parsing results solely for the purpose of determining the Winner.
8.3. IMPORTANT (App Store Requirement): Apple Inc. is not a sponsor, is not an organizer, and is not involved in any way with the contests, giveaways, lotteries, or sweepstakes conducted by users via the SOM Mobile App. All prizes are provided exclusively by the Giveaway Organizers.
9. Promotional Offers
9.1. You agree that we may send you information about updates or promotional offers if you have consented to this (or you have the right to opt-out in the settings).
10. Complaints and Disputes
10.1. For any questions or complaints, you can contact us via email: info@it-som.net. We will make every effort to respond within 10 days.
11. Intellectual Property Rights
11.1. The content of the Services (text, code, graphics, algorithms, Branding) is the property of SOM (Kivaro Tech).
11.2. Copying, decompiling (including reverse engineering the mobile app), or using the Content without our written consent is prohibited.
12. Third-Party Links
12.1. The Services may contain links to third-party websites. We are not responsible for their content or privacy policies.
13. Disclaimer of Warranties
13.1. The Services are provided “AS IS”. SOM and Apple Inc. do not provide any guarantees regarding uninterrupted operation, compatibility, or the absence of technical errors that may occur due to changes in social network APIs.
13.2. SOM and Apple Inc. bear no responsibility for the Organizer’s failure to pay (deliver) promised prizes to giveaway participants. All disputes between the Participant and the Organizer are resolved independently between them.
13.3. You agree that SOM is not responsible for failures on the part of internet providers or platforms (Instagram, TikTok, Facebook).
14. Term and Termination
14.1. SOM has the right to suspend or terminate your access to the Services (block your account) in case of your violation of these Terms, without prior notice.
15. Assignment of Rights
15.1. Rights under this Agreement may not be transferred by you to third parties, but may be assigned by SOM without restrictions.
16. Governing Law and Jurisdiction
16.1. These Terms are governed by the laws of Ukraine. All disputes are subject to resolution in the courts of Ukraine.
16.2. If any provision of this Agreement is found to be invalid, the remaining provisions shall remain in full force and effect.
